The High Court of Tanzania has overturned an order for the arrest and extradition of online activist Edger Mwakabela, popularly known as Sativa, ruling that the orders were legally invalid.
The decision was delivered on September 29, 2026, by High Court Judge Dafina Ndumbaro after hearing Sativa’s appeal against a ruling issued by the Kisutu Resident Magistrate’s Court.
Judge Ndumbaro said the arrest warrant and directives seeking to have Sativa returned from Kenya to Tanzania had no legal force and could not be enforced.
According to the judgment, the court found that proceedings in the lower court were conducted contrary to legal procedures, including proceeding without proper authority and relying on a defective affidavit.
Through his lawyer, Jebra Kambole, Sativa challenged the Kisutu court’s decision of November 28, 2025, arguing that the proceedings were conducted without him being summoned or given an opportunity to be heard.
He also argued that he was never served with a court summons or notified through the procedures required by law.
